Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of our Terms of Service and governs your use of CreatorCX (the "Service"). It applies to all content you upload, store, or otherwise process through the Service ("Your Content") and to all conduct in connection with the Service.

We may update this AUP at any time. Violation of this AUP is grounds for immediate content removal and/or account suspension or termination, with or without notice.

1. Age and Consent Requirements (Mandatory)

This is the most important section of this policy. By uploading any content depicting a real person, you represent and warrant, without exception, that:

  1. Every person depicted is, and was at the time the content was created, at least 18 years of age. This applies regardless of how the person appears, regardless of any costume, role-play, or characterization, and regardless of the laws of the jurisdiction where the content was created.
  2. You have obtained the informed consent of every person depicted for the content to be created, and for it to be stored and used by you through the Service.
  3. You are the "producer" of the content for purposes of 18 U.S.C. § 2257 (or the equivalent law of your jurisdiction) where that law applies, and you are solely responsible for verifying and maintaining the records that law requires — including a valid government-issued photo ID and any other documentation establishing that every depicted person was 18 or older at the time of production. CreatorCX is a private storage and organization tool; it does not act as your records custodian, and maintaining your own § 2257 records outside the Service, in compliance with applicable law, is solely your responsibility.
  4. You will produce your § 2257 records (or equivalent) to us promptly upon request, including in connection with any report, complaint, or legal process.
  5. You will immediately remove and cease use of any content if you learn or have reason to believe any depicted person was, at the time of creation, under the age of 18, or that consent was not validly obtained.

We have zero tolerance for content depicting or appearing to depict a minor, in any context, including fictional, animated, or "aged-up" depictions intended to resemble a minor. We use automated detection tools to screen uploaded content for known child sexual abuse material (CSAM). Any content identified or suspected as CSAM, and any account associated with it, will be removed, preserved as required by law, and reported to the National Center for Missing & Exploited Children (NCMEC) via its CyberTipline pursuant to 18 U.S.C. § 2258A, and/or to law enforcement, without prior notice to the user. We do not delete or further distribute suspected CSAM other than as directed by NCMEC or law enforcement.

2. Prohibited Content

You may not upload, store, or use the Service in connection with content that:

  • depicts, describes, or appears to depict anyone under the age of 18 in a sexual or suggestive manner, or any other child sexual abuse material (CSAM), in any form;
  • depicts non-consensual sexual content, including content shared without the depicted person's consent ("non-consensual intimate imagery");
  • depicts or facilitates human trafficking, sexual exploitation, or coercion of any kind;
  • depicts bestiality, necrophilia, or sexual content involving incapacitated individuals unable to consent;
  • infringes any third party's copyright, trademark, or other intellectual property rights;
  • violates any individual's right of privacy or publicity;
  • constitutes or promotes violence, terrorism, or illegal activity;
  • you do not have the legal right to create, upload, or store; or
  • otherwise violates applicable law in your jurisdiction or ours.

3. Prohibited Conduct

You may not:

  • use the Service to facilitate any of the prohibited content described in Section 2;
  • attempt to gain unauthorized access to another user's account, content, or data;
  • use the Service to circumvent the terms, policies, or security measures of any third-party platform (such as automated/unauthorized access to OnlyFans, Instagram, X, Reddit, or similar platforms);
  • use the Service for any unauthorized commercial scraping, resale, or redistribution of the Service itself;
  • upload malware or attempt to interfere with the security or normal operation of the Service;
  • misrepresent your identity or age, or impersonate any other person; or
  • use the Service in any way that exposes us to legal liability.

4. Your Responsibility for Third-Party Distribution

The Service helps you organize and plan content; it does not publish or distribute content on your behalf to any third-party platform. Once you post or share content outside the Service, your conduct on that third-party platform is governed solely by that platform's own terms, and you are solely responsible for complying with them. We have no visibility into, and no responsibility for, what happens to your content once it leaves the Service.

5. Attestation and Automated Screening

To use the Service, you must affirmatively attest to the representations in Section 1 at account signup and may be required to re-affirm them periodically or at upload. We log the timestamp and version of each attestation you make. A false attestation is a material breach of these Terms and the Acceptable Use Policy and may expose you to liability independent of any action we take.

Uploaded image and video content is automatically screened against known child-sexual-abuse-material (CSAM) hash databases before being made available in your library. This screening is a fraud/safety control, not a substitute for your obligations under Section 1, and its absence of a match is not a representation by us that content is lawful.

6. Reporting Violations

If you become aware of content or conduct on the Service that may violate this AUP, please report it immediately to hello@creatorcx.app. We will investigate reports in good faith and take appropriate action, which may include content removal, account suspension, or reporting to law enforcement.

7. Enforcement

We reserve the right, but do not assume the obligation, to monitor content on the Service. We may, at our sole discretion and without prior notice:

  • remove or disable access to any content that violates this AUP;
  • suspend or terminate any account that violates this AUP;
  • preserve and disclose content and account information to law enforcement or as required by law, particularly in connection with Section 1 violations; and
  • take any other action we reasonably believe necessary to protect the Service, our users, or the public.

Violation of Section 1 or 2 of this AUP, in particular, will result in immediate account termination and is not subject to appeal through ordinary customer support channels.

8. No Waiver

Our decision not to act on a particular violation does not waive our right to act on that violation, or any other violation, in the future.
